Working Time Regulation TU/E

General

The drafting of these working time regulations is in compliance with the provisions of  articles 4.1 up to and including 4.5 of the CAO [Collective Labour Agreement] NU.
Within the frameworks of these regulations faculties and services may draw up suitable working time regulations. Such regulations shall be drawn for a period of at least six months.

For organisational reasons, the mandatary may opt for a shorter term of validity, after holding consultation with the services council or the faculty council, as the case may be.

Individual employees may select their working hours in conformity with the provisions of the Selection Model  Conditions of Employment TU/E.

Arrangements about filling in working hours and terms shall be made during the annual performance appraisal and/or upon the application for selection of working hours within the framework of the Selection Model  Conditions of Employment TU/E, each year before 1 December.

Without prejudice to the employee's and his or her superior's own responsibility, the mandatary shall supervise compliance with those regulations and shall determine more detailed rules for this, where applicable.

Concepts: (CAO NU, Chapter 4)

  • hours of work: the number of hours of work stipulated in the appointment documentation;
  • working hours: the hours during which the employee effectively carries out his or her duty or activities;
  • business hours: average opening hours within the institution

Choice of flexible working hours

  • Full working hours = 38 hours a week
  • The 38 hour working week shall be filled in within 78 hours of business.
  •  For employees with a full working week, the minimum number of working hours shall be 36, with 40 being the maximum.
  • An employee engaged for 50% or more of the workload for full employment may fill in his or her working hours within a range of not more than 2 hours more or less than the number of working hours agreed to in conformity with the terms of his or her appointment.
  • For employees with a full working week, the working day shall begin between 7am and 9am and end between 3:30pm and 6pm.
  • The working day will begin and end between 7am and 6pm for employees with a part-time employment.
  • A working day shall not exceed 8 hours. For employees with a fulltime employment and a selected working week of 40 hours, the working hours therefore shall be 5 x 8 hours. A selection of 36 working hours can be filled in by, for instance, 4 days of 8 working hours and 1 day of 4 hours, or by 4 days of 7 hours and 1 day of 8 hours.
  • Arrangements for 4 days of 9 working hours per week can only be made if necessitated by the combination of work and care. Where applicable, arguments in support of that wish may be submitted to the supervisors of the services, together with a recommendation from the university welfare officer where necessary. Arrangements about working 4 x 9 hours, made before 1-1-2005, may be maintained.
  • For employees with a part-time employment, more variants of a working day are possible. Examples: appointment size = 60%; choice of working week = 24 hours. Those 24 hours may be filled in by, for instance, 1 day of 8 hours, 1 day of 6 hours, and 2 days of 5 hours.
  • In the case of fulltime employment, a maximum of 160 hours can be worked during each period of 4 weeks. Within the following frameworks the employer and employee may conclude specific arrangements about an (individual) working time arrangement within one's own management unit.

The average working week of 40 hours shall be filled in during the course of 78 hours of business.

Rest period in conformity with the standard regulations of the Dutch Working Hours Act

Employees younger than 18 shall observe a rest period of 12 hours between the end of a working day and the start of the next working day.

Employees older than 18 shall observe a rest period of 11 hours between subsequent working days.

A working day shall be interrupted by a break of at least 30 minutes, for every 5.5 consecutive hour period worked. That break may be split up into shorter breaks of at least 15 minutes.

If an employee works for more than 10 hours on one day, the breaks shall cumulatively cover at least 45 minutes. Breaks may be split into periods of at least 15 minutes.

Special working hours regulation (duty roster)

If this is deemed necessary for the welfare in labour circumstances or to comply with provisions of the Dutch Working Hours Act, a special working hours regulation (duty roster) may be drawn.

A special working hours regulation (duty roster) shall be drawn up by the faculty board/ services head following consultation with the employees involved.

60+ regulation (CAO NU, article 4.5)

The employer may grant an employee aged 60 and above permission to work 30 minutes less each day, at the latter's request.

This shall not apply to employees with whom working hours arrangements have already been concluded within the framework of a seniors arrangement.

Shorter working hours in the event of hot weather

Registration

The employer shall register the hours worked by the employees in such a manner as to render supervision of compliance with the Dutch Working Hours Act possible.

The following categories shall be exempted from such registration:

  • Trainees/laboratory assistants
  • employees who earn three times the minimum wage (starting from salary scale 11.10 or 12.4).
  • Doctorate students, TOIOs

Management units shall themselves be responsible for a proper registration of the above and for the (financial) consequence of the absence of the said registration.

Closure around Christmas and New Year

In consultation with employee organisations, the Executive Board decided at its meeting of 24 March 2009 to close the university for the years 2010/2011 up to and including 2019/2020 around Christmas and New Year. This closure shall be largely compensated for by the use of three days of leave and by the hours that the TU/E closed earlier on two carnival days and on funfair Wednesday (from 4pm). For that reason, closure on those latter days shall not take place. The closure at 4pm on working days between December 5th and December 24th shall be maintained.

Thanks to the obligation to take three days of leave, the TU/e is able to realise considerable energy savings.

1 January (New Year's Day) is a public holiday. According to the Collective Labour Agreement (CAO) this is a  day on which in principle no work is performed and the TU/e buildings are closed.

Closure around 'Koninginnedag' (the Queen's Birthday), 5 May and Ascension Day

In consultation with employee organisations, the Executive Board decided at its meeting of 24 March 2009 that a maximum of one day of leave shall be reserved for closure on the bridging days around 'Koninginnedag' and 5 May for the years 2010 up to and including 2019. For the closure on Friday after Ascension Day (bridging day) one day of leave shall be reserved.

8.4 - Closure on holidays according to the CAO

According to the CAO (art. 4.9) the following days are observed as public holidays: New Year’s Day, Good Friday, Easter Sunday, Easter Monday, 5 May, Ascension Day, Whit Sunday, Whit Monday, Christmas Day and Boxing Day and the day on which the Queen’s Birthday is celebrated in the Netherlands.
