Obligation to identification

As soon as a new employee starts his/her job, the employer is obligated to ascertain his/her identity.
The employer should therefore ask his/her identity card and keep a copy of it in the salary administration. This also applies to working children.

Proving identity can be done by means of the following documents:

  • Residence card I up to and including IV and EU/EER (before: A up to and including F);
  • Passport of a country of the European Economic Space;
  • Other national passports with a registration sticker that prooves that a residence permit has been applied for;
  • Refugee passport;
  • Diplomat passport

The copy must be clear and readable and the picture must be recognizable. You have to make a copy of all pages and of the front- and backside. As far as passports are concerned it is not necessary to make a copy of the blank pages, but only the pages that contain information about personal identification marks, the signature, stamps, children etc.

As far as identity cards are concerned you need to make a copy of both sides of the card.

Checklist to determine whether a proof of identity is original and valid:

  • Is the document original?<//font><//font>
  • Has the validity of the document expired or not?<//font><//font>
  • Does the document carry a picture of the employee?<//font><//font>
  • Does the stamp cover the page and the picture uninterruptedly?<//font><//font>
  • Are there no damages, cuts or glue remnants visible next to or around the picture?<//font><//font>
  • Are there no visible damages near to other variable data?<//font><//font>
  • Does the signature on the proof of identity match the signature on the income tax declaration and the working contract?<//font><//font>
  • Do the data in the document, such as length, age, gender, colour of eyes and nationality, match the employee?<//font><//font>
  • Does the employee know the data in the document, such as address, names of children, place and date of issue of the document?<//font><//font>
  • Is the document clearly readable? If  not the document is not valid.
  • Is the spelling of the place-name correct and is the use of capitals correct?
  • Does the document contain self-written insertions or alterations? Such adjustments make the document invalid if they are not accompanied by an authorisation stamp.
  • Is the amount, the order and the numbering of the pages correct? Are the pages loose or are they glued and do all the pages have the same document number?
